Komorebi no Mori Campsite Terms and Conditions

Article 1 (Scope of application)

  1. Accommodation contract entered into by Seon Village (hereinafter referred to as "our company"), which operates Seon Village Komorebi no Mori Campsite (hereinafter referred to as "this campsite"), with those who stay overnight or use the campsite for day trips. , day use contracts and related contracts shall be in accordance with the provisions of these Terms of Use (hereinafter referred to as "Terms of Use"), and matters not stipulated in these Terms of Use shall be subject to laws and regulations or generally established regulations. It depends on custom.

  2. If the Company agrees to a special agreement with a user of this campsite to the extent that it does not violate laws and customs, that special agreement shall take precedence, regardless of the provisions of the preceding paragraph.

Article 2 (Application for accommodation and day use)

  1. Persons who wish to apply for overnight stays or day use of this campsite must enter the following items and other matters deemed necessary by this campsite in the ledger specified by this campsite or on the online application site, etc. is needed.

    1. For accommodation: Name, email address, and date of stay of the representative of the guest.

    2. For day use: Name and email address of the user's representative

  2. The representative applying for accommodation or day use must be 20 years of age or older.

  3. Applications for overnight stays or day use must be made on behalf of one of the people staying at the campsite or using the campsite on a day trip, and application on behalf of a third party is prohibited. In the unlikely event that it is discovered that a third party has applied on behalf of another person, the application will be invalid.

Article 3 (Establishment of accommodation contract)

  1. The accommodation contract will come into effect when the reservation application is completed through an online application site operated by a third party designated by the Company or by other means within the period specified by the Campsite, and the Campsite accepts the application.

  2. The Company will provide an alternative reservation method even in the event that a person intending to apply for accommodation or day use is unable to do so due to the concentration of access to the online application site, server failure, communication problems, etc. We are not obligated to do so and will not be held responsible in the event that you are unable to make a reservation.

Article 4 (Establishment of day use contract)

With a day-use contract, you apply for use at this campsite on the day of use using the method specified by this campsite, our company accepts the application, and the usage fee, rental fee according to the application details, event participation fee, and other expenses are paid to this campsite. Payment shall be made when payment is made with a designated credit card or cash.

Article 5 (Rejection of accommodation contract and day use contract applications)

The Company may not accept applications for accommodation contracts and day use contracts in the following cases:

  1. When the application for accommodation and day use does not comply with the provisions of these Terms of Use.

  2. When there are reservations for more users than the number of people who can use the facilities of this campsite.

  3. When it is recognized for reasonable grounds that there is a risk that a person intending to stay overnight or use the campsite for a day trip may engage in acts that violate legal provisions, public order, or good morals at this campsite.

  4. When a person who intends to stay overnight or use the hotel for a day trip falls under any of the following A to C, or the Company determines that there is a suspicion of this for reasonable reasons.
    B. Organized crime group members, associate members of organized crime groups, persons associated with organized crime groups, and other anti-social forces.
    B. When the organized crime group or organized crime group member is a corporation or other organization that controls business activities.
    C. A corporation that has one of its officers who is a member of an organized crime group.

  5. When a person who intends to stay overnight or use the site for a day trip has behaved in the past at this campsite in a way that has caused a hindrance to the operation of this campsite or caused significant inconvenience to other users.

  6. When there is a possibility that a person intending to stay overnight or use the campsite for a day trip has a fever, is unwell, or has an infectious disease that requires restrictions on use of this campsite by law.

  7. When making violent demands on the staff of this campsite when making reservations for overnight stays or day use, or when being asked to bear a burden that exceeds a reasonable range.

  8. When accommodation or use is not possible due to natural disasters, bad weather, the spread of infectious diseases or preventive measures, facility failures, power outages, or other unavoidable reasons.

  9. When the Company determines that it is inappropriate for the campsite to be accommodated or used in light of the laws applicable to the campsite or prefectural regulations, etc.

  10. In addition to the preceding items, when the Company determines that the Contractor's overnight stay or day use of the Campsite is or is likely to impede the normal operation of the Campsite.

Article 6 (Accommodation list and user list)

  1. A person who has concluded an accommodation contract with our company to stay at this campsite (hereinafter referred to as the "accommodation contract holder") must enter the following items in the accommodation register at the front desk of this campsite on the day of accommodation.

    1. Names of the representative and all other guests, emergency contact information for the representative

    2. If the guest is a foreigner, his or her nationality and passport number

    3. Scheduled departure date

    4. Other matters deemed necessary by this campsite

  2. Persons who have entered into a contract for day use of this campsite with our company (hereinafter referred to as "day use contract holder") must write the following items on the list at the front desk of this campsite on the day of use.

    1. Name, address, telephone number of representative, names of all users

    2. Other matters deemed necessary by this campsite

Article 7 (Business hours)

The business hours of this campsite and each facility within the campsite shall be as specified on the campsite's website, notices and materials distributed within the campsite, etc.

Article 8 (Payment of accommodation fees, day use fees, etc.)

  1. The amount of accommodation fees, day use fees, rental fees, event participation fees, etc. shall be as specified on the reservation site of this campsite and the materials provided at the front desk.

  2. Accommodation contract holders and day trip users (hereinafter collectively referred to as ``contractors'') shall pay accommodation fees and other expenses confirmed at the time of reservation using a credit card approved by this campsite, and then stay overnight. Or, expenses related to rentals or events applied for at this campsite on the day of use shall be paid in cash or credit card each time or when requested by this campsite.

  3. In the event that this campground provides accommodation and day-use facilities to the contractor, and the contracting party does not stay overnight or use the day-trip facility of his/her own will even though the campsite is available for use, the contracting party shall not be allowed to stay overnight or use the day-trip facility. The accommodation fee or day-use fee will be paid to this campsite.

Article 9 (Advance storage of the contractor's baggage or personal effects)

At this campground, we cannot store luggage such as camping equipment for overnight guests or day trip users by sending it in advance by courier or post.

Article 10 (Compliance with usage rules/prohibited acts)

  1. Within this campground, the Contractor shall comply with the precautions and prohibitions regarding the use of this campsite, as well as any other rules established by the Company (hereinafter referred to as You must comply with the "Usage Rules").

  2. Contractors are prohibited from engaging in the following acts within this campsite.

    1. Entering places where entry is prohibited

    2. Use of noise caused by drones, radio-controlled airplanes, fireworks, and other machinery, etc.

    3. Bringing in animals whose movement is prohibited by laws, ordinances, or other administrative agency rules, etc.

    4. Selling goods or providing services within the campground without prior consent from the Company; subleasing the space within the campground contracted by the contractor to a third party; reselling the right to participate in events within the campground; Other commercial activities

    5. Solicitation for religious or political activities

    6. Behavior that causes significant inconvenience to other contract holders

    7. Acts that may or may hinder the normal operation of this campsite.

    8. Other acts that are listed as prohibited on the campsite's homepage, on notices within the campsite, in handouts, etc.

Article 11 (Accommodation Contractor's Right to Cancel Contract)

  1. The Accommodation Contractor may cancel the Accommodation Contract (hereinafter referred to as "Cancellation") by notifying the Campsite by the specified deadline using the method specified by the Company.

  2. If the cancellation by the Accommodation Contractor in the preceding paragraph is due to the Accommodation Contractor's convenience, the Company will charge the prescribed cancellation fee.

  3. If the Accommodation Contractor does not contact us and does not arrive at the Campsite by 6:00 pm on the day of accommodation, the Company may deem that the Accommodation Contract has been canceled by the Accommodation Contractor.

  4. In the case of cancellation pursuant to this article, the Company will charge the accommodation contractor a cancellation fee.

Article 12 (Right to cancel contract for this campsite)

  1. This campsite may cancel the accommodation contract or day use contract in the following cases.

    1. When the Contractor violates these Terms of Use or Usage Rules

    2. When the contractor engages in the prohibited acts set forth in Article 10, Paragraph 2.

    3. When the Contractor repeatedly makes and cancels reservations for this campsite more than the prescribed number of times determined by the Company.

    4. When the Contractor falls under any of the following (A) to (C), or the Company determines that there is a suspicion of this for reasonable reasons.
      B. Organized crime groups, members of organized crime groups, associate members of organized crime groups, persons associated with organized crime groups, and other anti-social forces.
      B. When the organized crime group or organized crime group member is a corporation or other organization that controls business activities.
      C. A corporation that has one of its officers who is a member of an organized crime group.

    5. When the Contractor makes violent demands on the campsite staff or other related parties, or demands a burden that exceeds a reasonable range, when making a reservation, staying overnight, or using the campsite for a day trip.

    6. When the Company determines that the Contractor is likely to cause or cause damage to the life, body, or property of other Contractors.

    7. When the Company determines that the Contractor has engaged in, or is likely to engage in, an act that violates the laws, regulations, or good morals applicable to this campsite.

    8. In addition to the preceding items, when the Company determines that the Contractor's overnight stay or day use of the Campsite is or is likely to impede the normal operation of the Campsite.

  2. When the Company cancels the accommodation contract or day-use contract based on the provisions of the preceding paragraph, the Company shall not be obligated to refund the accommodation fee and day-use fee.

  3. Due to force majeure such as bad weather such as typhoons, heavy rain, heavy snow, and strong winds, natural disasters such as tsunamis and earthquakes, spread of infectious diseases, power outages, disruption of roads or transportation, wars, terrorism, strikes, and amendments to laws and regulations, our company may cancel the camp. When it is determined that it is difficult to provide safe use of the facility, or when a government agency requests that business be curtailed, or an order or notice prohibiting business is issued, the contractor shall be notified in advance as much as possible. You may cancel the accommodation contract and usage contract for this campsite.

  4. In the case of the preceding paragraph, the Company shall not charge accommodation fees or other usage fees.

  5. The Company cannot compensate the Contractor for any damage caused to the Contractor due to cancellation pursuant to Paragraph 3 of this Article.

Article 13 (Responsibility of this campsite)

  1. Contractors shall manage and store their personal belongings, cash, vehicles, etc. at their own responsibility, and the Company shall have no obligation to store these.

  2. As a general rule, our company is not responsible for any injuries, illnesses, infections, or loss, defacement, or theft of personal belongings of contractors that occur within the campsite. However, this does not apply in the case of intentional or gross negligence on the part of our company.

  3. Any belongings or cash left behind by the Contractor at this campsite will be kept by the Company for one month including the date of discovery, after which they will be delivered to the police station that has jurisdiction over this campsite, and we will not respond to any other inquiries. We will not be able to respond or provide compensation.

Article 14 (Responsibility regarding vehicles)

  1. Our company has no obligation to manage the vehicles of contractors parked in the parking lot of this campsite, and is not responsible for theft, damage, accidents, etc. of such vehicles. However, this does not apply in the case of intentional or gross negligence on the part of our company.

  2. Our company is not responsible for accidents, damage, stains, etc. caused by the contractor's driving errors or other causes on the roads within this campground.

  3. Our company is not responsible for any troubles that occur between contractors and other contractors or other third parties that occur in the parking lot of this campsite or on the roads within the campsite.

Article 15 (Contractor's Responsibilities)

If the facilities and rental equipment of this campsite suffer damage such as staining, burning, or loss due to the Contractor's intention or negligence, the Company may claim compensation for the damage from the Contractor.

Article 16 (Protection of personal information)

  1. Our company will appropriately manage the personal information of contractors such as name, gender, age, telephone number, e-mail address, address, etc. acquired based on these Terms of Use in accordance with related laws and regulations, and will manage the campground's operations, event implementation, etc. The information will be used only for the purpose of contacting guests regarding accommodation and day use of this campsite, maintaining the property and mental and physical safety of policyholders, providing event insurance and other services, and providing event-related insurance services.

  2. Notwithstanding the preceding paragraph, the Company shall disclose the personal information of the Contractor set forth in the preceding paragraph if necessary to ensure the safety of the Contractor's life, body, or property, or if necessary to comply with laws and regulations applicable to the Company. In accordance with relevant laws and regulations, information may be provided to administrative agencies, judicial agencies, other public institutions, medical facilities, etc. to the minimum extent necessary.

Article 17 (Changes to these Terms of Use)

  1. The Company may change the contents of these Terms of Use without prior notice if the Company deems it necessary.

  2. Any changes to these Terms of Use will be posted on this campsite website, etc., and will apply from the time they are posted.

  3. If an accommodation or day use contract has been concluded before the changes to these Terms of Use, the Terms of Use valid as of the date of use of this facility shall apply.

Article 18 Agreed Jurisdiction Court

The Contractor agrees that the Yamanashi District Court shall have exclusive jurisdiction of the first instance for any disputes regarding these Terms of Use.
